This notice explains what personal information Agulhas Code (Pty) Ltd collects through this website and in the course of an enquiry, why we collect it, and your rights under the Protection of Personal Information Act (POPIA).
Who we are
The responsible party is Agulhas Code (Pty) Ltd, registration number 2026/306425/07, based in Durban, KwaZulu-Natal, South Africa. Our Information Officer is Darrshan Govender, who can be reached at dgovender@agulhascode.co.za.
What we collect
- Enquiry forms. Your name, email address, and whatever you choose to tell us, plus company name, phone number and team size where a form asks for them.
- Email and messages. The content of correspondence you send us, and your contact details.
- Technical data. Our hosting provider records standard server logs, such as IP address and request times, to keep the site secure and working.
This website does not use advertising cookies, analytics trackers or third-party fonts, and it does not build a profile of you.
Why we use it
We use your information only to respond to your enquiry, to prepare and carry out any engagement you ask for, and to keep the records the law requires of us. We rely on your consent, which you give when you submit a form, and on our legitimate interest in answering people who contact us. We do not sell or rent personal information, and we do not add you to a mailing list without asking.
Who else processes it
We use a small number of service providers, who act as operators on our behalf under POPIA:
- Website hosting and form handling, provided by Netlify, Inc., which stores form submissions on servers that may be outside South Africa.
- Email, provided by our business email host.
Where information is stored outside South Africa, we use providers that are bound by data protection obligations comparable to POPIA, as section 72 of the Act requires.
How long we keep it
Enquiries that do not lead to an engagement are kept for up to 24 months and then deleted. Records relating to an engagement are kept for as long as the engagement lasts and afterwards for as long as tax and company law require.
How we protect it
Access is limited to the people who need it and protected by multi-factor authentication. Traffic to this website is encrypted. If a security compromise affecting your information occurs, we will notify you and the Information Regulator as section 22 of POPIA requires.
Your rights
You may ask us what personal information we hold about you, ask us to correct or delete it, withdraw your consent, or object to our processing it. Email dgovender@agulhascode.co.za and we will respond within a reasonable time. If you are not satisfied with our response, you may lodge a complaint with the Information Regulator of South Africa.
Client data in our engagements
When we work with information belonging to a client, such as records reviewed during an audit or documents indexed for a knowledge assistant, we do so as the client's operator under a written agreement. That agreement, not this notice, governs how such information is handled.
